01 Terms of Service

These Terms of Service ("Terms") govern your use of the website godabu.com and all services provided by DABU S.R.L., a company registered in EU ("DABU", "we", "us", or "our").

By accessing our website or requesting any of our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1.1 Service Agreement

Services provided by DABU S.R.L. include, but are not limited to: website building, AI automation, Telegram bot development, social media automation, crypto intelligence tools, server monitoring solutions, and AI photo editing integrations.

1.2 Payment Terms

All prices are quoted in EUn Lei (RON) or Euro (EUR) as agreed. The Free Demo Website service is provided at no cost with no obligation. Paid services require agreement prior to commencement. Payment is due upon delivery unless otherwise agreed in writing.

DABU S.R.L. shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability in any matter is limited to the amount paid for the specific service in question.

1.5 Governing Law

These Terms are governed by the laws of EU. Any disputes shall be subject to the exclusive jurisdiction of EUn courts.

02 What We Deliver & What We Don't

2.1 What DABU delivers

• Professional, responsive websites built to agreed specifications
• AI-powered automation workflows and Telegram bots
• Deployment to Netlify or agreed hosting platform
• Source code and files for paid projects upon final payment
• Social media channel setup and automation configuration
• Server monitoring bot configured to your infrastructure
• Demo websites (free, for evaluation, not for commercial use)

2.2 Hosting

By default, DABU deploys and hosts websites on Netlify, which is included in the standard package. If a client requests deployment to a custom or third-party hosting environment instead of Netlify, the client is responsible for providing DABU with everything required for that deployment (hosting account access, server credentials, DNS access, and any other configuration details), and any additional setup time may be billed separately.

Because client websites are static (no server-side login panel or CMS), DABU does not create or provide the client with hosting account credentials to manage the website directly. Website updates and changes are handled by DABU upon request, unless a different arrangement has been explicitly agreed in writing.

2.3 What DABU does NOT deliver

• Guaranteed search engine rankings (SEO results take time and depend on many external factors)
• Legal, financial, or medical advice of any kind
• Content that is illegal, defamatory, or infringes third-party rights
• Ongoing maintenance unless explicitly contracted
• Third-party platform accounts (e.g., domain registrars, hosting accounts — client must own these)

03 Intellectual Property Rights

3.1 Client-provided content

Any content you provide to us (logos, text, images, brand assets) remains your intellectual property. You grant DABU S.R.L. a limited licence to use this content solely for the purpose of delivering your requested service.

3.2 Work product ownership

Upon full payment of agreed fees, ownership of the final deliverable (website code, bot configuration, automation workflow) transfers to the client. Until full payment is received, all work product remains the property of DABU S.R.L..

3.3 AI-generated content

Websites and content generated using AI tools (including Anthropic's Claude API) may not be protectable by copyright in all jurisdictions. Clients acknowledge this when requesting AI-generated deliverables. DABU S.R.L. makes no warranties regarding the copyright status of AI-generated content.

3.4 DABU proprietary systems

Our internal workflow systems, n8n automations, and operational processes remain the exclusive intellectual property of DABU S.R.L. and are not transferred to clients.

3.5 Portfolio rights

Unless explicitly prohibited in writing, DABU S.R.L. reserves the right to showcase delivered work in our portfolio and marketing materials.

04 AI Processing Disclosure

Specifically, the following information submitted via our demo request form may be processed by Anthropic's Claude AI API:

• Business name
• Business type
• Business description

Personal contact information (email, phone) is not sent to the AI API. It is stored only on DABU's secure infrastructure (Hetzner, Germany, EU).

Anthropic is a US-based company. Processing by their API involves transfer of data outside the EU. This is covered by Anthropic's Data Processing Agreement and Standard Contractual Clauses. For more information: anthropic.com/privacy

05 Privacy Policy

DABU S.R.L. ("we", "us") is committed to protecting your personal data in accordance with EU Regulation 2016/679 (GDPR).

5.1 Data we collect

• Demo request form: Email, phone, business name, business type, description, IP address, referrer URL, browser user agent, submission timestamp
• Contact form: Name, email, subject, message, submission timestamp
• Analytics (if accepted): Page views, session duration, device type — anonymised
• Cookies: See Cookie Policy section below

5.2 Why we collect this data

• To provide the requested demo website service
• To respond to your enquiries
• To prevent spam and fraudulent submissions
• To improve our services

5.3 Legal basis for processing

We process your data on the legal basis of consent (Article 6(1)(a) GDPR), which you provide by submitting our forms, and legitimate interests (Article 6(1)(f) GDPR) for fraud prevention and service improvement.

5.4 Data retention

Form submission data is retained for up to 12 months from the date of submission. Deleted sites' associated data is removed upon deletion. You may request deletion at any time.

5.5 Data processors (third parties)

• Netlify Inc. (USA) — website hosting and form processing; covered by Standard Contractual Clauses
• Hetzner Online GmbH (Germany, EU) — server infrastructure
• n8n GmbH (Germany, EU) — workflow automation
• Anthropic PBC (USA) — AI processing for demo generation; covered by Standard Contractual Clauses
• Google LLC (USA) — Google Sheets for internal data management; covered by Standard Contractual Clauses

5.6 Data security

We implement technical and organisational measures including encrypted connections (HTTPS), access controls, and EU-based server infrastructure where possible. We do not sell your data to third parties.

06 Your GDPR Rights

As a data subject under EU GDPR, you have the following rights:

• Right of Access (Art. 15): Request a copy of the personal data we hold about you
• Right to Rectification (Art. 16): Request correction of inaccurate data
• Right to Erasure (Art. 17): Request deletion of your data ("right to be forgotten")
• Right to Restriction (Art. 18): Request restriction of processing in certain circumstances
• Right to Data Portability (Art. 20): Receive your data in a structured, machine-readable format
• Right to Object (Art. 21): Object to processing based on legitimate interests
• Right to Withdraw Consent: Withdraw consent at any time without affecting prior processing

07 Cookie Policy

Our website uses cookies and similar tracking technologies. By clicking "Accept All" on the cookie banner, you consent to the use of all cookies described below.

7.1 Essential cookies (always active)

• dabu_lang — Stores your language preference (EN/RO). Duration: persistent. No personal data.
• dabu_cookie_consent — Stores your cookie consent choice. Duration: persistent. No personal data.
• dabu_last_submit / dabu_contact_sent — Session storage used to prevent duplicate form submissions. Cleared when browser tab closes.

7.2 Optional analytics cookies (accepted only)

If you accept all cookies, we may use privacy-friendly analytics to understand how visitors use our site. No personal data is collected. No third-party advertising cookies are used.

7.3 Third-party cookies

Our embedded content (e.g., the Netlify-hosted demo iframe on the Projects page) may set cookies from Netlify. These are subject to Netlify's cookie policy.

7.4 Managing cookies

You can withdraw consent at any time by clearing your browser's local storage and cookies. You can also configure your browser to block cookies entirely, though some website features may not function correctly.

7.5 Dreptul de Retragere / Right of Withdrawal

Conform OG 34/2014 (Ordonanța privind drepturile consumatorilor în cadrul contractelor) și Directivei UE 2011/83/UE, consumatorii au, în principiu, dreptul de a se retrage dintr-un contract la distanță în termen de 14 zile calendaristice, fără a fi necesară justificarea deciziei.

Serviciul de demo website gratuit este prestat fără obligații financiare. Nu se aplică nicio taxă și nu există un contract comercial aferent. Dacă doriți oprirea prestării sau ștergerea datelor, contactați-ne la contact@godabu.com.

Pentru Servicii cu Plată

La momentul plasării unei comenzi ferme pentru servicii cu plată, veți fi informat în scris cu privire la dreptul de retragere aplicabil situației dumneavoastră specifice, înainte de începerea prestării.

Pentru a exercita dreptul de retragere (dacă aplicabil), trimiteți o declarație clară prin email la contact@godabu.com înainte de expirarea termenului de 14 zile de la data contractului.
